The lawyers at Combies Hanson, P.C. recently resolved a case involving a young woman who was shot and killed at an urban housing complex. The young girl left behind a grieving family, also victim to the tragic circumstances. The decedent, a young woman in her twenties, gathered with relatives at an apartment complex . While speaking with family in the apartment’s courtyard, the party came under fire and the decedent was struck by at least one stray bullet. She stumbled back into the nearby apartment and fell to the ground, holding her neck and bleeding in front of her family. EMT’s transferred her to a local hospital where she underwent emergency surgery. A CT scan revealed she had an anoxic brain injury and doctors declared her brain dead. Shortly thereafter an order was given to take her off life-support.

A negligent security action was filed against the apartment complex owner and its management company. The suit alleged that Defendants’ security was insufficient given the history and foreseeability of violent crime in the area. Plaintiff was prepared to show at trial that the security company retained by Defendants worked infrequent hours and was not present on the evening the incident took place. Additionally, Plaintiff intended to prove that the apartment complex lacked appropriate perimeter and access control, allowing violent crime to continue unabated within and around the confines of the apartment complex. Plaintiff was further prepared to show that the defendant’s expert prepared a security evaluation decades earlier calling for additional security measures that were never completed.

The parties attempt to mediate the matter was unsuccessful. The case resolved two days before trial for $2,000,000.00 (Two Million Dollars).
